Terms of service

Last updated: 2 September 2026

1. Who these terms are between

These terms are between Torwarden ("we", "us"), and the organisation that installs or uses Torwarden ("you"). If you are accepting these terms for an organisation, you confirm you are authorised to do so.

2. What Torwarden is

Torwarden is software you install and run on your own infrastructure. It is not a hosted service. We do not operate it, we do not have access to it, and we do not receive data from it. Its availability, security and correctness in your environment depend on how you deploy and maintain it.

3. Licence

Subject to these terms and to payment of any applicable fees, we grant you a non-exclusive, non-transferable licence to install and use Torwarden for your own internal business purposes, for the number of monitored hosts your licence permits.

Torwarden may be used without a licence key for up to ten monitored hosts. That limit is enforced by the software and is not a trial period; it does not expire.

You may not sublicense, resell or provide Torwarden to third parties as a service, remove or alter licensing or attribution notices, or attempt to circumvent the host limit your licence sets.

4. Licence keys

Licence keys are signed files. They are verified locally by your installation and require no connection to us, at installation or afterwards. A key that has expired stops permitting new hosts; it does not stop the software running or monitoring the hosts you already have.

5. Your data

All data Torwarden collects stays in your installation. We have no access to it and no ability to obtain it. You are responsible for the security of the systems you run it on, for the credentials you configure in it, and for backing up its databases.

6. Support

Support, if included in your licence, is provided on the terms and for the period stated in that licence. Because we have no access to your installation, support depends on the information you are able to share — the product's diagnostic bundle is built to be safe to send, and excludes hostnames, credentials and configured values.

7. Updates

We may release updates. You choose whether and when to install them; nothing updates itself and nothing checks for updates. Schema migrations are one-way, so we recommend a backup before any upgrade.

8. Billing, renewal and refunds

Paid plans are billed in advance, for the period you chose at checkout, and renew automatically at the same price until you cancel. You can cancel at any time from the customer portal we email you after purchase. Cancelling stops the next payment; your licence keeps working until the end of the period you have already paid for, and then returns to the free limit of ten hosts.

If you want a refund, ask within 14 days of a payment and you will get it in full, with no questions asked. Write to support@torwarden.com or use the customer portal. A refunded licence stops working at its next check.

Payments are taken by Polar, which acts as merchant of record. Polar is the seller of record for the transaction, issues your invoice, and handles VAT and sales tax. Refunds are paid back to the method you used.

If we change the price of a plan, the new price applies from your next renewal and never to a period you have already paid for. We will tell you before it takes effect.

9. Warranties

We warrant that we have the right to license Torwarden to you. Otherwise, so far as the law permits, Torwarden is provided "as is" and we exclude all other warranties, express or implied, including fitness for a particular purpose.

Torwarden is a monitoring tool, not a guarantee. It will not detect every fault, and a fault it does detect may be reported late or not delivered — a notification channel can fail, a rule can be misconfigured, and a machine can fail in a way no threshold covers. Do not rely on it as the only control protecting a system where failure causes harm.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for loss of profit, revenue, data, business or goodwill, or for indirect or consequential loss; and our total liability under these terms is limited to the fees you paid in the twelve months before the claim arose.

11. Term and termination

These terms apply for as long as you use Torwarden. You may stop at any time by uninstalling it. We may terminate your licence if you materially breach these terms and do not remedy the breach within 30 days of being asked to. On termination you must stop using the software; data you have already collected remains yours.

12. Governing law

These terms are governed by the law of Albania, and the courts of Albania have exclusive jurisdiction.
